Terms Of Service

1. The Services

The Services help businesses build chatbots, forms, funnels and booking calendars, capture and manage leads, and run marketing. We may add, change or remove features. We will give reasonable notice before removing a feature you pay for.

2. Your Account

• You must be at least 18 years old and give accurate account information.
• Keep your sign-in details secure. You are responsible for activity under your account and for the people you invite to your workspace.
• Tell us promptly at [email protected] if you believe your account has been compromised.

3. Subscriptions And Payment

• Fees, billing periods and any usage limits are shown when you subscribe.
• Subscriptions renew automatically until cancelled. You can cancel at any time; unless your plan says otherwise, access continues until the end of the paid period.
• Fees exclude taxes unless stated. Refunds are provided where the plan you bought says so or where the law requires.
• We may suspend the Services if a payment fails and is not resolved.

4. Your Content And Customer Data

You keep ownership of the content you create and the information about your customers you put into the Services. You give us the permission we need to host, process and display it to provide the Services to you. You are responsible for having the rights, notices and consents needed to use that information, including to contact the people in it.

5. Facebook, Instagram And Other Connected Platforms

• When you connect a Facebook Page, Instagram account or other platform, you authorise us to act on your behalf to provide the features you turn on, such as replying to messages or managing ads.
• You must follow the terms and policies of each platform you connect, including Meta’s Platform Terms, Commercial Terms and messaging policies.
• Only send automated messages to people who contacted you or agreed to hear from you, and only within the messaging windows the platform allows. Do not send spam.
• Platforms can change or withdraw features without notice. We are not responsible for a platform’s availability or decisions, and we may pause a connection that puts the platform integration at risk.

6. AI Features

AI-generated responses can be wrong, incomplete or inappropriate. Review what your chatbots and AI features say, and do not rely on them for medical, legal, financial or other professional advice. You are responsible for the content your chatbots send to your customers.

7. Acceptable Use

You must not use the Services to:

• Break any law or anyone’s rights, including privacy, consumer-protection and anti-spam laws.
• Send unsolicited, deceptive or harassing messages, or impersonate anyone.
• Collect sensitive information such as payment card numbers, health information or government ID numbers through chatbots unless the law allows it and you have the required consent.
• Upload malware, probe or disrupt the Services, or get around usage limits or security measures.
• Resell or provide the Services to others except as your plan allows.

8. Our Intellectual Property

The Services, including the software, designs and trademarks, belong to us or our licensors. These terms give you a limited, non-exclusive, non-transferable right to use the Services while your subscription is active.

9. Third-Party Services

The Services connect to services we do not control, such as Meta, payment processors and AI model providers. Their terms govern your use of them, and we are not responsible for them.

10. Suspension And Termination

You may stop using the Services and close your account at any time. We may suspend or end your access if you break these terms, create risk or legal exposure for us or others, or do not pay. Where reasonable we will give notice first. Export anything you want to keep before your account closes; after termination we may delete your data.

11. Disclaimers

The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Services will be uninterrupted or error-free.

12. Limitation Of Liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Services in breach of these terms, or your breach of law or of a connected platform’s terms.

14. Governing Law

These terms are governed by the laws of Wyoming, without regard to its conflict-of-law rules. The courts located in Wyoming have exclusive jurisdiction over any dispute, unless the law where you live requires otherwise.

15. Changes To These Terms

We may update these terms. We will post the new version here with its effective date and, for significant changes, let account holders know in advance. Continuing to use the Services after the change takes effect means you accept it.
